Practice areas

Six areas of law, and one attorney who handles them.

Every practice area on this page is taken from the firm's own published list, not invented and not padded out. This is a general practice, which in a town this size is the point, because the same person can handle the bankruptcy, the divorce and the will rather than sending you to three offices in Dayton. Nothing on this page is legal advice, and contacting the office does not create an attorney client relationship. If your problem is not listed here, ring (937) 669-8020 and ask, and you will get a straight answer about whether it is the right office for you.

Bankruptcy

Bankruptcy

The firm's own bankruptcy page describes helping hundreds of individuals and families with bankruptcy matters. Chapter 7 and Chapter 13, alternatives to bankruptcy, credit card debt, creditor harassment, repossessions, stopping foreclosure, stopping lawsuits and garnishments, loan modifications, second mortgages and rebuilding credit afterwards. If you are getting letters you have stopped opening, that is the point at which people usually ring.

Criminal Defense

Criminal Defense

Misdemeanors and felonies, assault, domestic violence, drug offenses, theft offenses, juvenile matters, resisting arrest, search and seizure questions, and expungements for a record that is still following you around years later. If you have been charged, the useful thing to know is that this office answers the phone until 8pm on weekdays. Call (937) 669-8020.

Family Law and Divorce

Family Law and Divorce

Divorce, dissolution and divorce mediation, child custody, child support, visitation, paternity, father's rights, grandparent's rights, spousal support, property division, division of pensions, relocations, guardianship, restraining orders and step-parent adoption. The firm's own list distinguishes simple from complex cases, which is a fair way to put it, because these are not all the same job.

Traffic, OVI and DUI

Traffic, OVI and DUI

License suspension, DMV hearings, field sobriety test questions, challenging the evidence, second offenses, under 21 cases, felony and commercial cases, reckless driving, fleeing an officer, driving without insurance and, in the firm's own words, all other moving violations. A ticket you were going to just pay is often worth one phone call first, because of what it does to your licence and your insurance.

Civil and Business Matters

Civil and Business Matters

Contracts, disputes and breaches, commercial and business litigation, landlord and tenant matters, property damage claims, disputes over money and property, business law, and real estate closings and sales. For a small business in Miami County, having somebody local who already knows the file tends to beat finding somebody new every time something goes wrong.

Wills and Probate

Wills and Probate

Wills, living wills, powers of attorney and probate. This is the work people put off for a decade and then need urgently, usually on behalf of somebody else. It is also the least intimidating conversation on this list, so if you have been meaning to get a will done, the office is open until 8pm and it does not take long.

How it works

How to get in front of an attorney.

1

Call (937) 669-8020

Weekdays 8am to 8pm. That twelve hour day is genuinely unusual for a law office and it is the reason to ring here first, because you do not have to take time off work to make the call. There is a fax on (937) 669-8023 if you have documents to send.

2

Say what kind of matter it is

Bankruptcy, a criminal charge, a divorce or custody question, a ticket or an OVI, a civil dispute, or a will. Naming it in the first sentence gets you to the right conversation faster. If there is a court date already set, say the date straight away, because that changes how quickly things need to move.

3

Ask about the consultation

The office's own wording is to call to schedule an initial consultation, and being straight with you, it does not publish whether that first meeting is free or what it costs. That is a completely fair thing to ask when you ring, and asking it costs nothing. Evening and Saturday appointments are available.

4

Bring your paperwork

Whatever you have. The citation, the court notice, the letters from creditors, the filed papers, the existing will. A first conversation is much more useful when the actual documents are on the table, and it saves a second appointment. Nothing on this page is legal advice, so the meeting is where you find out where you really stand.

About us

Thirty years at the bar, a clean record, and a website frozen in 2013.

Tom O. Merritt has been admitted to the Ohio bar since 12 November 1996, admitted by examination, with his law degree from the University of Dayton. The Supreme Court of Ohio attorney directory lists him under registration number 66661 as Active, with no discipline history and no administrative sanctions or suspensions on record. He opened Merritt Law Office in Tipp City in August 2005 and has run it as a general practice since, covering Miami, Montgomery, Shelby, Darke, Greene and Clark Counties from an office just off Interstate 75 at Exit 68. It is a solo practice, so the attorney you speak to on the phone is the attorney on your case. Now the part that has nothing to do with the law. The firm's current website runs on a builder template dated February 2015, with a copyright line hard coded to 2013, and its content has not been touched since March 2022. The contact form's configuration posts to nowhere at all, so messages sent through it are very likely going nowhere. The email address is printed as text rather than a clickable link, which on a phone means it may as well not be there. A headline on the family law page reads Tip City rather than Tipp City. Three different street addresses for this office are circulating across the major legal directories, only one of which is right. The Justia profile is claimed but completely empty, no photograph, no biography, nothing. There is real positive feedback published about this firm and not one line of it appears on its own site. And the strongest thing about the practice, an 8am to 8pm weekday, sits in a footer block instead of at the top of the page. All of that is fixable, and none of it requires a single change to how the firm actually practises law.

A twelve hour weekday is unusual for a law office and it is the single most useful thing about this firm, so it belongs at the top of the page rather than buried at the bottom of one. Monday to Friday, 8:00am to 8:00pm, which means you can be seen before work or after it without taking a day off. On Saturday there is a genuine conflict worth flagging honestly, the firm's own site says evening and Saturday appointments are available, which reads as by arrangement, while its Google listing publishes Saturday as a regular 8:00am to 8:00pm open day. Both of those are the firm's own listings and they disagree, so please ring (937) 669-8020 and ask rather than turning up on a Saturday and hoping. Sunday is closed. There is a fax on (937) 669-8023.

1480 W Main Street, Tipp City, OH 45371

The office is at 1480 West Main Street in Tipp City, conveniently located just off Interstate 75 near Exit 68, which is the firm's own description of it. Worth knowing before you set off, three different street addresses for this office are circulating online. Two large legal directories list a South Garber Drive address and a national map site lists a different West Main Street number entirely. Neither is right. The correct address is 1480 West Main Street, and it is the one on file with the Supreme Court of Ohio. If your map is arguing with you, ring (937) 669-8020.

Get in touch

Tell us what you are dealing with.

A charge, a court date, a divorce or custody question, creditors you cannot keep up with, a ticket, a dispute, or a will you have been meaning to get done. Say what it is in a sentence and whether there is already a date in the diary. Calling (937) 669-8020 is the fastest route, weekdays until 8pm, and this form works too.

Please read this bit. Nothing on this page is legal advice, and sending this form does not create an attorney client relationship or protect anything you write as confidential, so keep it to the shape of the problem rather than the details. Fees are not published here because they depend entirely on the matter, and asking what a first consultation involves and what it costs is a normal question to put on the phone.

Ask about your situation

What kind of matter, and any date already set.

Thanks! Your request is in, we will reach out shortly. (Demo site, no message was actually sent.)
